Terms of Service

By sending a text message to ChatPlaylist or using our website at chatplaylist.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our service. By texting our number, you acknowledge that you have read and understood both these Terms and our Privacy Policy, and you consent to the collection and use of your data as described therein.

ChatPlaylist is an AI-powered service that generates custom Spotify playlists based on text message requests. You send us an SMS describing the type of playlist you want, and our AI creates a playlist on Spotify and texts you a link. The service also includes conversational AI interactions related to music and playlists.

You must be at least 13 years of age to use ChatPlaylist. If you are between 13 and 18 years of age, you must have your parent or legal guardian's permission to use the service. By using the service, you represent and warrant that you meet these eligibility requirements.

By texting ChatPlaylist, you expressly consent to:

• Receiving automated SMS messages from us, including playlist links, status updates, service notifications, and responses to your messages
• The storage of your phone number for the purpose of providing the service and communicating with you
• Standard messaging and data rates from your mobile carrier may apply to messages sent to and received from ChatPlaylist

Message frequency varies based on your usage. You can opt out of messages at any time by texting "STOP" to our number. For help, text "HELP".

General

When you opt-in to the service, we will send you a message to confirm your signup.

By opting into messages, you agree to receive recurring automated marketing and informational text messages from Chat Playlist AI. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Chat Playlist AI. Chat Playlist AI reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Chat Playlist AI also reserves the right to change the short code or phone number or alphanumeric sender where messages are sent.

Your usual message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your mobile provider. Your mobile provider is not liable for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase.

Carriers are not liable for delayed or undelivered messages.

Cancellation

Messages will provide instructions to unsubscribe either by texting STOP or through an included link. After you unsubscribe, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Chat Playlist AI again, just sign up as you did the first time and Chat Playlist AI will start sending messages to you again.

For support regarding our services, email us at support@troov.app or, if supported, text "HELP" to our messages at any time and we will respond with instructions on how to unsubscribe. If we include a link in messages we send you from Chat Playlist AI, you may also access instructions on how to unsubscribe and our company information by following that link.

Transfer of Number

You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply "STOP" from the original number, unsubscribe using the link included in our messages (if one is provided), or notify us of your old number at support@troov.app. The duty to inform us based on the above events is a condition of using this service to receive messages.

Messaging Terms Changes

We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. If you do not agree to a change to these Messaging Terms, you should cancel your enrollment with our messaging program. Your continued enrollment following such changes shall constitute your acceptance of such changes.

ChatPlaylist offers a free tier with the following limits:

• 3 playlists per month
• 20 messages per month

Paid subscription plans are available for higher usage limits. Subscriptions are billed through Stripe. By subscribing, you agree to the following:

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You may cancel your subscription at any time by texting "SUBSCRIBE" to manage your subscription or through the Stripe customer portal
• Refunds are not provided for partial billing periods
• We reserve the right to change pricing with reasonable notice

• Playlists are created on Spotify under the ChatPlaylist account and shared with you via a link
• Playlists expire and are automatically deleted from Spotify after 5 days
• You may save, follow, or copy a playlist to your personal Spotify account before it expires to keep it permanently
• A Spotify account (free or premium) is required to access playlists
• We are not affiliated with Spotify. Spotify is a trademark of Spotify AB. Your use of Spotify is governed by Spotify's own terms of service

ChatPlaylist uses artificial intelligence to generate playlists and conversational responses. You acknowledge that:

• AI-generated playlists and responses may not always perfectly match your expectations
• Song selections are based on AI interpretation and Spotify catalog availability
• We do not guarantee the availability of any specific song or artist on Spotify
• AI responses are generated automatically and may occasionally contain errors or inaccuracies

You agree not to:

• Use the service for any unlawful purpose or in violation of applicable laws
• Attempt to abuse, overwhelm, or interfere with the service through excessive automated requests or spam
• Impersonate another person or misrepresent your identity
• Use the service to send content that is harmful, threatening, abusive, or otherwise objectionable
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the service
• Resell, redistribute, or commercially exploit the service without our written consent

The ChatPlaylist service, brand, website, and all related content are the property of ChatPlaylist. Playlists generated by the service contain songs owned by their respective artists and labels. You do not acquire any ownership rights to the songs, only a temporary link to a Spotify playlist. The playlist curation (selection and arrangement of songs) is generated by our AI service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE ACCURACY, QUALITY, OR SUITABILITY OF ANY AI-GENERATED PLAYLISTS OR RESPONSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATPLAYLIST AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

We reserve the right to suspend or terminate your access to the service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the service ceases immediately. You may request deletion of your data by contacting us at support@troov.app.

We may modify these Terms at any time. If we make material changes, we will notify you via SMS or by posting the updated Terms on our website. Your continued use of the service after changes are posted constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from or related to these Terms or the service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
